Terms of Service

Please read these Terms of Service (“Terms”) carefully before accessing or using the Vidnow application and related services (collectively, the “App” or “Services”). The App is operated by Beijing Youge Network Technology Co., Ltd., located at No. 796, No. 7 East Liulin Road, Sujiatuo Town, Haidian District, Beijing, China.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

1. Service Description

Vidnow is a mobile application that allows users to browse creative video templates, upload photos or videos, and use AI-powered tools to create transformed or stylized videos and images, including face transformation, appearance modification, motion transfer, and other creative effects.

The Services may also include user profiles, saved creations, likes, sharing features, community content, template requests, notifications, advertising-supported features, or other features that may be introduced or updated from time to time.

Certain templates or creative features may be made available through rewarded advertisements. Availability of such advertisements may vary depending on region, device, network conditions, advertising inventory, and other factors outside Vidnow’s direct control.

AI-generated content may contain errors, unexpected results, distortions, inaccurate representations, or other limitations. Vidnow does not guarantee that any generated content will be accurate, realistic, complete, suitable for a particular purpose, or available without interruption.

2. Eligibility

• You must be at least 18 years old, or the minimum legal age required in your jurisdiction, and legally capable of entering into a binding agreement.
• If you are under 18, you may use the App only with the permission and supervision of a parent or legal guardian where permitted by applicable law.
• You may not use the App if doing so is prohibited by the laws applicable to you.
• By using the App, you confirm that you own, control, or have obtained all necessary rights, permissions, and consents for every photo, video, image, audio file, or other material that you upload or process.
• If your content contains an identifiable person, you confirm that you have obtained all permissions required to use that person’s image, likeness, voice, name, or other personal characteristics.
• You are responsible for ensuring that your use of the App and any generated content complies with applicable laws and the rights of other people.

3. Acceptable Use & Prohibited Content

You agree not to use the App to:

• Create, upload, process, request, share, or distribute pornographic, sexually explicit, or adult-only content.
• Create sexualized, exploitative, abusive, or otherwise harmful content involving minors or persons who appear to be minors.
• Create non-consensual intimate imagery, sexual deepfakes, or manipulated content depicting a person without that person’s permission.
• Impersonate, defame, threaten, harass, stalk, bully, or deliberately mislead another person.
• Create or distribute deceptive or harmful deepfakes, including content intended to commit fraud, facilitate identity theft, manipulate elections, or falsely represent a person’s statements or actions.
• Upload or process content that violates copyright, trademark, trade secret, privacy, publicity, personality, moral, or other legal rights of any person or entity.
• Upload content containing personal information, confidential information, or sensitive information belonging to another person without proper authorization.
• Create or distribute content that promotes violence, terrorism, criminal activity, self-harm, hate speech, discrimination, or serious physical or emotional harm.
• Circumvent, disable, interfere with, or attempt to defeat the security, usage limits, moderation systems, advertising systems, or technical controls of the App.
• Reverse engineer, decompile, disassemble, copy, modify, interfere with, or create derivative works based on the App, its code, AI models, algorithms, systems, or backend infrastructure.
• Use bots, scripts, crawlers, automated tools, emulators, or other unauthorized methods to access or interact with the App.
• Manipulate, automate, falsify, or otherwise abuse advertisements or rewarded-ad interactions in order to obtain unauthorized access to templates, features, rewards, or Services.
• Use the App for unlawful, fraudulent, abusive, or unauthorized commercial purposes.
• Use the App or generated content in a way that violates any applicable local, national, or international law or regulation.

You are solely responsible for the content you upload, create, process, publish, or share through the App.

We may, at our discretion and where permitted by law, review, moderate, refuse, restrict, remove, disable access to, or delete content or accounts that we reasonably believe violate these Terms, our policies, or applicable law. We may also preserve or disclose information when reasonably necessary to comply with legal obligations, protect users, investigate abuse, or protect the security of the Services.

4. Ownership & Rights

• Your Uploaded Content: You retain ownership of the original photos, videos, images, and other content that you upload to the App.
• Your Generated Content: To the extent permitted by applicable law, you retain the rights you may have in content generated from your uploaded content. However, AI-generated content may not qualify for copyright or other intellectual property protection in every jurisdiction.
• Third-Party Rights: Your rights in generated content may be subject to the rights of other persons or entities whose likeness, image, voice, performance, trademarks, copyrighted material, or other protected elements appear in that content.
• License to Vidnow: You grant Vidnow a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify as technically necessary, transmit, display, and otherwise use your uploaded content and generated content solely as necessary to operate, provide, secure, maintain, improve, and support the Services, or as otherwise permitted by our Privacy Policy.
• Community and Shared Content: If you choose to publish or share content through a community feature, you authorize Vidnow to display, distribute, and make that content available to other users or persons with access to the relevant sharing link. You should not publish content that you do not want others to view or use.
• No Unrequested Model Training: Vidnow will not use your uploaded media or face-related processing data to train general-purpose AI models unless we separately obtain your permission or provide any notice and choice required by applicable law.
• Vidnow’s Property: Vidnow and its licensors retain all rights, title, and interest in the App, Services, software, code, designs, interfaces, templates owned by Vidnow, AI models, algorithms, trademarks, logos, databases, and backend infrastructure.
• Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, sell, license, rent, lease, modify, publicly display, publicly perform, reverse engineer, or create derivative works from Vidnow’s property.

5. Advertising & Rewarded Ads

Vidnow is primarily supported by advertising and may allow users to access certain templates, features, or creative Services by viewing advertisements, including rewarded advertisements.

• Advertisements may be provided by third-party advertising partners and may vary based on your device, region, network conditions, advertising availability, consent choices, and other factors.
• Where applicable, certain features may become available after you successfully complete a rewarded advertisement.
• Watching or completing an advertisement does not guarantee that a particular advertisement, template, feature, or Service will always remain available.
• Vidnow does not guarantee the availability, frequency, duration, content, or type of advertisements shown within the App.
• Advertising partners may process certain device, advertising, usage, or interaction information as described in our Privacy Policy and subject to applicable laws and platform requirements.
• Where required, we will obtain your consent before using information for personalized advertising or tracking.
• If you choose not to consent to personalized advertising or tracking, you may still receive non-personalized or contextual advertisements where available.
• You may not use bots, automated tools, emulators, fraudulent interactions, repeated manipulation, or other unauthorized methods to obtain rewarded-ad benefits.
• We may withhold, revoke, or restrict access to advertising-based rewards where we reasonably determine that an advertisement interaction was fraudulent, manipulated, incomplete, or otherwise inconsistent with these Terms.
• Third-party advertisements may promote products, services, websites, or applications that are not owned or controlled by Vidnow. Vidnow does not endorse and is not responsible for the content, products, services, availability, or privacy practices of third-party advertisers, except as required by applicable law.

6. Disclaimers & Limitation of Liability

• The App and Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise, except to the extent that such warranties cannot be excluded under applicable law.
• We do not guarantee that the App or Services will be uninterrupted, secure, error-free, accurate, complete, compatible with every device, or available at all times.
• We do not guarantee that advertisements or rewarded advertisements will always be available, successfully load, complete, or provide access to any particular feature.
• We do not guarantee that any AI-generated output will meet your expectations, look realistic, preserve every feature of the source media, be free from bias or distortion, or be suitable for any particular purpose.
• You are solely responsible for reviewing generated content before using, downloading, publishing, or sharing it.
• You are solely responsible for obtaining all rights, permissions, licenses, and consents required for your uploaded content and generated content.
• To the fullest extent permitted by law, Vidnow will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, or use resulting from or related to the App, Services, advertisements, uploaded content, or generated content.
• To the fullest extent permitted by applicable law, Vidnow’s total aggregate liability for all claims arising out of or relating to the App, Services, or these Terms will not exceed USD 100.
• Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or rights that cannot be waived under applicable consumer-protection law.

7. Termination and Suspension

You may stop using the App at any time. Where account functionality is available, you may request account deletion through the in-App deletion feature or by contacting us at support@vidnow.org.

We may suspend, restrict, or terminate your access to the App or any feature if:

• You violate these Terms or other applicable policies.
• We reasonably believe your use creates a security, legal, fraud, advertising abuse, or safety risk.
• We reasonably believe you have manipulated or fraudulently interacted with advertisements or rewarded-ad systems.
• We are required to do so by law or a governmental authority.
• The App or a particular feature is discontinued, modified, or no longer commercially viable.

Where reasonably practicable, we will provide notice before suspension or termination. We may act without advance notice when necessary to protect users, the Services, advertising systems, or our legal rights.

Upon termination, your right to access and use the App will end. Provisions that by their nature should survive termination, including ownership, licenses, disclaimers, limitation of liability, dispute resolution, and applicable law, will continue to apply.

Account deletion and content deletion may be subject to the retention periods described in our Privacy Policy, including retention necessary for security, fraud prevention, legal compliance, dispute resolution, or backup recovery.

8. Changes to Terms

We may update these Terms from time to time to reflect changes to the App, Services, technology, legal requirements, advertising practices, or business operations.

The “Last Updated” date at the top of these Terms indicates when the Terms were last revised. For material changes, we will provide reasonable notice through the App, our website, or another legally appropriate method.

Your continued use of the App after the updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law. If you do not agree to the revised Terms, you must stop using the App.

9. Governing Law & Dispute Resolution

These Terms will be governed by the laws of the People's Republic of China, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws in your country provide otherwise.

Any dispute arising out of or relating to these Terms or the Services will be submitted to the competent courts located in Beijing, China, unless applicable law gives you the right to bring a claim in another court or requires a different dispute-resolution process.

Nothing in this section limits any mandatory rights you may have under the laws of your country or region.

10. Third-Party Platforms and Services

The App may be distributed through or interact with third-party platforms and services, including Apple App Store, Google Play, cloud hosting providers, advertising providers, analytics providers, AI processing providers, content-delivery providers, and social or sharing services.

Your use of those third-party platforms and services may also be subject to their own terms and privacy policies. Vidnow is not responsible for the acts, omissions, availability, content, or policies of third-party platforms or services, except as required by applicable law.

If you download the App from Apple App Store or Google Play, Apple or Google may be considered a third-party beneficiary of these Terms to the extent provided in their applicable terms. However, Apple and Google are not responsible for the App’s content, maintenance, or support obligations unless required by their applicable agreements or applicable law.
